1. Who We Are and Acceptance of These Terms

These terms of service (the “Terms”) govern access to and use of this website, operated by Land of Nomads Group (“Land of Nomads”, “the Group”). Contact: info@landofnomadsgroup.com and WhatsApp +63 962 074 0450.

By accessing and using this site you accept the Terms as published at the time of your visit. If you do not agree with them, please do not use the site.

2. Definitions

  • Site: this website and all of its pages, in Spanish and in English.
  • Visitor (or “you”): any person who accesses the Site, whether or not they go on to contact the Group.
  • Content: the texts, data, images, videos, downloadable documents, designs and any other material published on the Site.
  • Units: the eco villas and eco apartments in the Group’s Philippine developments, acquired through a 99-year long-term lease (leasehold).
  • Forms: the contact and information session request forms available on the Site.

3. What the Site Provides

The Site provides general commercial information about the Group, its San Fernando (Camarines Sur) and El Nido (Palawan) developments, the 99-year leasehold structure under Philippine law, the developer’s direct instalment payment plans and the optional managed rental service, together with channels to request information, book an information session or reach the team on WhatsApp.

The Site is not an electronic contracting platform. No acquisition contract is concluded through the Site, no payments are taken through it, and no Units are reserved through it. The entire contracting process takes place outside the Site, through an individual private contract between the acquirer and the relevant Group entity.

4. Informational Content, Not an Offer

The Content is general information. It is not a binding contractual offer and does not form part of any contract. The features, availability and financial conditions of the Units are those set out in the pre-contractual and contractual documentation provided to each interested person during the contracting process, which prevails over any Content on the Site.

Nor does the Content constitute an offer, promotion or placement of securities, financial instruments or interests in any collective vehicle managed by third parties, in any jurisdiction. What the Group markets is a real right of long-term lease (leasehold) over a specific, identified real estate unit, registered under Philippine law, together with optional and separable rental management services.

5. Regulatory Notices

  • No advice. Nothing published on the Site constitutes financial, legal, tax or any other form of advice. The Group encourages every Visitor to obtain independent, qualified advice in their country of residence before signing any contract.
  • Estimates, not promises. Any figures, ranges, rental projections or scenarios appearing on the Site or in the Group’s commercial materials are estimates based on assumptions stated in each development’s documentation. They are not a promise or assurance of results. Actual results depend on, among other factors, occupancy, operating costs, exchange rates and the performance of the Philippine tourism market, and may be lower than estimated.
  • Nature of the right acquired. The 99-year leasehold grants a long-term right to use and enjoy a specific registered unit. It does not convey freehold (fee simple) title to the land, which remains with its Philippine titleholder as required by the Constitution and the laws of the Philippines.
  • Optional managed rental. The rental management service is independent from the leasehold contract, is formalised in a separate agreement, is entirely voluntary and may be terminated in accordance with its terms. Acquiring a Unit does not oblige anyone to contract rental management.
  • Territorial scope. The information on the Site is not directed at persons in any jurisdiction where its publication or use would be contrary to local law or regulation. It is the Visitor’s responsibility to check the restrictions applicable in their jurisdiction before acting on the Content.
  • Tax obligations. Acquirers are responsible for their tax and reporting obligations in their country of tax residence. The Group does not provide tax advice and under no circumstances suggests omitting any filing before the competent authorities.

6. Contracting Takes Place Outside the Site

When a Visitor requests information or an information session, the Group’s team makes contact to explain the product, answer questions and, if the person decides to move forward, deliver the pre-contractual documentation and the corresponding private contract. Completion may require verification of the acquirer’s identity and source of funds and compliance with applicable anti-money-laundering regulations. The leasehold contract is governed by Philippine law and follows the notarial and registration steps required by Philippine legislation.

7. Acceptable Use of the Site

You agree to use the Site in accordance with the law, these Terms and good faith. By way of example, the following is prohibited:

  • Using the Site for unlawful purposes or in ways harmful to the Group or third parties.
  • Submitting false details through the Forms or impersonating another person.
  • Any activity that may damage, overload or impair the Site or prevent its normal use, including bulk automated extraction of Content without authorisation.
  • Circumventing or tampering with the Site’s technical measures.

The Group may restrict access to the Site in response to uses that breach the above.

8. Forms and Communications

The Forms collect name, email address and phone number for the purpose of handling your request. That data is entered into the Group’s customer relationship management (CRM) system, from which the commercial team manages the response and follow-up. The WhatsApp channel is additionally governed by the WhatsApp platform’s terms. You warrant that the details you provide are accurate and belong to you.

9. Third-Party Content and Links

The Site includes links to external platforms, such as video testimonials hosted on YouTube, which open in a new tab. Access to those services is subject to their respective terms and policies. The Group does not control, and accepts no responsibility for, the content, availability or practices of linked third-party sites.

10. Rights Over the Content

The Content, the Land of Nomads brand and the Group’s distinctive signs are protected by copyright and trademark law. You may view the Content and keep copies for personal use. Any other use, in particular reproduction or distribution for commercial purposes, requires the Group’s prior written authorisation.

11. Site Availability

The Group endeavours to keep the Site available and up to date but does not commit to uninterrupted availability. The Site may be temporarily suspended for maintenance, updates or technical reasons. The Group may modify the structure, design and Content of the Site at any time.

12. Limitation of Liability

To the fullest extent permitted by applicable law, the Group is not liable for damage arising from: (a) decisions taken by a Visitor solely on the basis of the Content, without the pre-contractual documentation or independent advice; (b) interruptions, technical errors or unavailability of the Site; (c) third-party content or services reached through links; or (d) uses of the Site contrary to these Terms. Nothing in these Terms excludes liability that cannot lawfully be excluded, nor does it limit any rights granted to you by applicable consumer protection rules where they apply.

13. Changes to These Terms

The Group may update these Terms to reflect legal, technical or operational changes. The version in force is the one published on the Site with its last updated date. Changes apply from publication and have no retroactive effect on situations already settled.

14. Severability

If any clause of these Terms is held invalid or unenforceable, that finding will not affect the remaining clauses, which will remain valid and effective to the fullest possible extent.

15. Governing Law and Jurisdiction

These Terms are governed by the law applicable to the site operator in its place of incorporation, without prejudice to any mandatory protective rules applicable to you in your place of residence. Leasehold contracts and their associated services are governed by their respective clauses, with the leasehold itself subject to Philippine law.
